Hon’ble Rajasthan Real Estate Appellate Tribunal Agreement for sale need not be in writing and any other documents containing requisite contents of the agreement will suffice. Thus, in the instant case, as has been already observed, a booking confirmation letter dated 03rd February, 2014 contain different clauses including payment schedule and likely date of possession. This allotment letter is duly signed by both the parties and thus the contents of the allotment letter reflect agreed position between the parties except the total cost of the unit. In view of this fact, we are of the opinion that it is evidently clear that parties have entered into a transaction for the sale and purchase of the said flat / unit. The, intention of parties matters more and not the nomenclature of transaction instrument.
