In this case, NCLT Ahmedabad Bench pointed out that the notices were issued and duly served to the respondent but even thereafter, no one appeared for the Suspended Management to explain the conduct and the allegations as narrated in the application. After considering the facts, we are of the view that the personal presence of the Suspended Management is necessary to ascertain the facts. We therefore, direct the respondents, Suspended Management to appear in person either physically or through virtual mode and to place their say on the matter. It is made clear that in case of non-compliance, the only recourse left would be issuance of either bailable warrant or non-bailable warrant.
