Direction U/S 37 of RE (R&D) Act, 2016 regarding up-dating the status on website by the promoters.
The promoters are required under the provisions of section 11(1) of RE(R&D)Act,2016 read with rule 15 of Odisha RE(R&D)Rules, 2017 to create a web page on the website of the Authority and enter all details of the project in all the fields as provided for public viewing including ;
(a) Details of the registration granted by the authority ;
(b) quarterly up-to-date the list of number and types of apartments or plots, as the case may be, booked ;
(c) quarterly up-to-date the list of numbers of garages booked ;
(d) quarterly up-to-date the list of approvals taken and the approvals which are pending subsequent to commencement certificate ;
(e) quarterly up-to-date status of the project ; and
(f) such other information and documents as may be specified by the regulations made by the authority .
ii) It is observed that some of the promoters are not regularly uploading the relevant information in the website of ORERA as required under the law for public viewing. This is a serious lapse on the part of the concerned promoters and will be liable for imposition of penalty U/S 61 of RE(R&D) Act,2016 and for revocation of the registration under section 7 of the said Act in case of continuous default by a promoter.
iii) All the promoters are hereby directed to update the information on quarterly basis within 15 days from the expiry of each quarter failing which penal action will be taken as per above provisions of the Act.
