Hon’ble High Court held that the Appellate Court has the power to impose the condition of deposit a part of compensation while suspending suspension of sentence and on non-deposit, the same would either automatically be vacated, if provided in the order or the said order of suspension of sentence on non-deposit of said amount can be vacated. Any other interpretation of the said provision, that the amount so ordered to be deposited can be recovered as fine under Section 421 Cr.P.C., would lead to frustrating the very object and purpose of the amendment.
