Adjudicating Authority is not expected to ascertain the veracity of documents produced – Drive India Enterprise Solutions Ltd. Vs. BTM Exports Ltd. – NCLT New Delhi Bench Court-VI

NCLT New Delhi Bench Court-VI found that: (i) The Operational Creditor initially filed the section 9 petition with annexures consisting more than 2900 pages However, subsequently the Petitioner filed an IA to place on record additional documents through which the Operational Creditor reduced the number of documents which was allowed by this Tribunal vide order dated 21.03.2022. (ii) Further serious allegations of fraud and forgery were made in the pleadings which this Tribunal cannot adjudicate since the Adjudicating Authority is not expected to ascertain the veracity of documents produced. (iii) CIRP application filed u/s 9 was dismissed.
