ORDER

Based on incidents past and present and issues raised by NCLT stakeholders in their repeated representations, the report of HOD, on a preliminary review of the above representations and the report on the incidents, keeping in mind the interest of the Institution and to ensure proper working of the NCLT Chandigarh Bench, the Competent Authority on the administrative side has directed as follows:-

(i) The work assigned to Shri. Umesh Kumar Shukla Member (T), NCLT Chandigarh Bench, hearing of cases in Court I & II stands withdrawn until further orders.

(ii) Consequently, Shri Harnam Singh Thakur, Member (J), NCLT Chandigarh will conduct Court I & II of NCLT Chandigarh Bench and hear cases along with Member (T) Shri Ashish Verma, presently Member (T) NCLT Allahabad Bench with effect from 06.01.2025 through VC until further orders.

(iii) Shri Harnam Singh Thakur Member (J) and Shri Ashish Verma, Member (T) will hold and hear case of NCLT Chandigarh Bench I & II on Monday, Tuesday and Wednesday first half and second half respectively.

(iv) The NCLT Allahabad Bench consisting of Shri Praveen Gupta Member (J) and Shri Ashish Verma Member (T) will hear cases on Thursday and Friday full day. All cases of NCLT Allahabad Bench listed on Monday, Tuesday and Wednesday of the week will be heard on Thursday and Friday of the week or as notified by the court.

(v) Hon’ble Member (T) Shri Umesh Kumar Shukla will, however, complete the heard and reserved cases within a period of Ten (10) days from the date of this order and pronounce the same forthwith in consultation with Member (J).

(vi) In order to avoid any further delay in passing order’s in reserved cases Shri Umesh Kumar Shukla, Member (T) will complete and pronounce the reserved cases without listing of the reserved cases for further clarification.

(vii) This order is passed by the Competent Authority in terms of Rules 16 (d), (e) & (f) of the NCLT Rules, 2016.
