In this case, the petitioner has filed an original application before the DRT, seeking recovery against its borrowers. Hon’ble High Court held that it is open to the petitioner to establish its claim before the DRT and this Court sitting under Article 226 cannot investigate upon factual matters, which require evidence. This Writ Petition is disposed of with liberty to the petitioner to make its claim before the Debt Recovery Tribunal.
