Authorisation to discharge the functions of Chairperson DRAT Mumbai for deciding appeal

In exercise of the powers conferred by sub-section (3) of section 8 of the Recovery of Debts and Bankruptcy Act, 1993 (51 of 1993), the Central Government hereby authorises the Chairperson of the Debts Recovery Appellate Tribunal, Chennai to discharge also the functions of the Chairperson of the Debts Recovery Appellate Tribunal, Mumbai for deciding the appeal in the matter of ‘Pravara Renewable Energy Limited versus Padmashri Dr Vitthalrao Vikhe Patil Sahakari Sakhar Karkhana Limited and others (Diary No. 79 of 2022 and its connected proceedings)’, in addition to his being the Chairperson of the Debts Recovery Appellate Tribunal, Chennai

e-filing of pleadings by applicants is mandatory and any other form of filing shall not be taken on record – DRTs and DRATs Electronic Filing (Amendment) Rules, 2023

Vide Notification dated 31.01.2023, the rule 3(2) substituted as the e-filing of pleadings by applicants is mandatory and any other form of filing shall not be taken on record and deleted proviso which was as provided that e-filing of pleading shall be mandatory where the debt to be recovered, as mentioned in the application, is rupees one hundred crore and above.

e-filing of pleading before DRT & DRAT shall be mandatory where the debt to be recovered is Rs. 100 crore and above – GSR-501(E) dated 22.07.2021 – RDB Act 1993

As per sub-rule (2) of Rule 3 of The DRT and DRAT Electronic Filing Rules, 2020, the e-filing of pleadings by applicants shall be optional. Now, a proviso has been inserted that e-filing of pleading shall be mandatory where the debt to be recovered, as mentioned in the application, is rupees one hundred crore and above.
