If Developer has shown the amount taken from home buyer under borrowing head and charged the interest thereon under Finance Cost in his Financial statements than that amount is constituted as debt under IBC- Nikhil Mehta and Sons(HUF) & Ors. Vs. AMR Infrastructure Ltd.-NCLAT
