The Commercial Courts Act, 2015

Act No. 4 of 2016

[31st December, 2015]

An Act to provide for the constitution of Commercial Courts, 1[Commercial Appellate Courts,] Commercial Division and Commercial Appellate Division in the High Courts for adjudicating commercial disputes of specified value and matters connected therewith or incidental thereto.

BE it enacted by Parliament in the Sixty-sixth Year of the Republic of India as follows:—

Chapter-I Preliminary

Section 1: Short title, extent and commencement.

1. 2[(1). This Act may be called the Commercial Courts Act, 2015.]

(2). It extends to the whole of India 3[***].

(3). It shall be deemed to have come into force on the 23rd day of October, 2015.

2. Substituted by the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts (Amendment) Act, 2018 (w.e.f. 3-5-2018), the sub-section:

“(1) This Act may be called the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Act, 2015.” 

3. Omitted by the Jammu and Kashmir Reorganisation Act, 2019, vide section 95 and the Fifth Schedule (w.e.f. 31-10- 2019), the words “except the State of Jammu and Kashmir“.
