O R D E R
The impugned judgment/order dated 23.08.2023 passed by the National Company Law Appellant Tribunal1, Chennai Bench affirms the order passed by the National Company Law Tribunal2, Bengaluru Bench, including the directions quoted in paragraph ‘17’ of the impugned judgment/order dated 23.08.2023.
During the course of hearing, learned counsel appearing on behalf of the appellant – M/S Teestavalley Power Transmission Ltd. (Now Sikkim Power Transmission Ltd.) states that he will be satisfied if it is clarified that the impugned judgment/order, including the order passed by the NCLT, will have no bearing on the merits of the proceedings pending before the learned Arbitrator.
We do not think that the impugned judgment/order, and the order passed by the NCLT, make any observations/findings on the merits of the proceedings pending before the learned Arbitrator.
Recording the aforesaid, the present appeal is dismissed.
Pending application(s), if any, shall stand disposed of.
