ORDER
Sub: Registration fee for registration of proprietorship firms as real estate agents.
Whereas sub-rule (2) of rule 10 of the Rajasthan Real Estate (Regulation and Development) Rules, 2017 (hereinafter called `the Rules’) provides that at the time of application for registration, a real estate agent shall pay a registration fee for a sum of rupees ten thousand in case of the applicant being an individual or rupees fifty thousand in case of the applicant being anyone other than an individual;
And whereas the Hon’ble Rajasthan Real Estate Appellate Tribunal has, in its judgment dated 21.08.2017 in Appeal No. RAJ-RERA-C-2017-2006 “Rohit Modi Vs. Registrar, RERA”, held that an individual can work in his own name or any other name, implying thereby that an individual agent can also work in the name of an enterprise of which he is the sole proprietor and same registration fee shall be charged whether the real estate agent obtains registration in his name or in the name of his proprietorship firm;
And whereas the application for registration of real estate agent (Form H prescribed under sub-rule (1) of rule 10 of the Rules) has also clubbed the proprietorship firm with the individual rather than with the company, society, LLP and partnership firms;
And whereas a common online form is provided on RERA web portal for individual and proprietorship firm and a separate form for other categories of real estate agents;
And whereas, in view of the foregoing position of the Rules and the practical difficulties in charging different fee for individual and proprietorship firm, it is considered desirable to have the same amount of registration fee for the individual as well as for the proprietorship firms.
Now, therefore, it is hereby ordered that a registration fee of Rs. 10,000/-shall be charged from an individual applicant whether he applies for registration as real estate agent in his own name or in the name of a proprietorship firm of
which he is the proprietor. If, however, a real estate agent who has obtained registration in his individual name wishes to obtain a revised registration in the name of his proprietorship firm, a modification fee of Rs. 5,000/- shall be charged for modification in the registration details and issue of a modified registration certificate.
This order shall come into force with immediate effect. However, the cases of registration of sole proprietorship as real estate agent decided in the past will not be re-opened and no refund will be made therein.
This issues with the approval of Hon’ble Chairman of the Authority.
